The plaintiff was injured on the first day of March, 1949, at about 6:30 a. m. while he was on his way to work as he was walking in a northerly direction on the sidewalk along the west side of North 36th street approaching West Center street in said city of Milwaukee at a point where it crossed a public alleyway. The sidewalk, as it crossed the alley, was covered with a thick coating of ice as the result of snow-falls which had melted and froze. This ice was very slippery and uneven due to footprints which pedestrians using the same made in the snow during times of thaw which thereafter were frozen into the surface. There were also two deep ruts in the ice on the crossing at right angles to pedestrians path of travel on the sidewalk which had been caused by vehicles using the alley. These ruts were from three to five inches deep and approximately six inches in width, or the width of an ordinary automobile tire. The plaintiff testified that as he attempted to step over one of such deep ruts his foot slipped on the ice into the rut, and he could not free his foot from the rut and fell, breaking his leg.
